This website (the "Site"), all products sold herein ("Products"), and the 30-Day Beauty Program ("Services") are owned and operated by KAYDEAN QADDASA NIAGA (Business Reg. No: SA0393468-M), a business registered in Malaysia (hereinafter referred to as "KAYDEAN", "the Company", "We", "Us", or "Our")
1. NATURE OF PRODUCTS & QUASI-MEDICAL DISCLAIMER
1.1 Cosmetic Classification: All KAYDEAN Products are registered with the National Pharmaceutical Regulatory Agency (NPRA) and hold valid NOT numbers. They are classified as skincare products intended for barrier recovery and maintenance.
1.2 No Medical Advice: While KAYDEAN provides "Quasi-Medical" insights and personalized routines, the Services and Products do not constitute professional medical advice, diagnosis, or treatment.
1.3 Individual Results: Skin chemistry varies. We do not guarantee that every individual will achieve identical results. Any "Service" provided is a recommendation based on user-provided data; the User assumes the risk of the suitability of the recommendation.
2. MANDATORY SAFETY PROTOCOL: THE PATCH TEST
2.1 Condition of Sale: It is a fundamental condition of this contract that the Customer performs a 24-hour Patch Test on a small area of skin (e.g., behind the ear or inner forearm) before full application of any Product.
2.2 Assumption of Risk: By purchasing, the Customer agrees that KAYDEAN shall not be held liable for any adverse or allergic reactions if the Customer failed to perform the Patch Test or continued use despite irritation.
3. 30-DAY BEAUTY PROGRAM & "MONEY-BACK" GUARANTEE
3.1 The "No Improvement" Refund: KAYDEAN offers a refund if "no improvement" is seen within 30 days of the Program. To qualify, the Customer must strictly adhere to the following "Anti-Fraud" safeguards:

Documentation: Customer must provide "Before" and "After" photos with time-stamps (Day 1 and Day 30) taken in identical lighting conditions.

Compliance: Customer must demonstrate 100% adherence to the Personalized Routine provided by KAYDEAN. Failure to follow the routine voids the guarantee.

External Factors: The guarantee is void if the Customer uses third-party active ingredients (e.g., strong acids, retinols from other brands) during the 30-day period.
3.2 Discretion: KAYDEAN reserves the sole right to determine what constitutes "improvement" based on the evidence provided.
4. SHIPPING, DELIVERY & TRANSFER OF RISK
4.1 Third-Party Logistics: Shipping is handled by third-party couriers. KAYDEAN is not an agent of the courier.
4.2 Passing of Risk: Risk of loss or damage to the Products passes to the Customer the moment the Products are handed over to the courier service.
4.3 Delivery Failure: We are not responsible for delays caused by the courier, customs, or incorrect addresses provided by the Customer.
5. RETURNS & REFUND POLICY
5.1 Hygiene Rule: Due to the nature of skincare and hygiene regulations in Malaysia, opened or used Products are strictly non-returnable and non-refundable.
5.2 Wrong Items: Refunds or exchanges are only permitted if KAYDEAN has shipped the incorrect item. The Customer must notify us within 48 hours of receipt with unboxing video/photo evidence. The item must remain sealed/unopened.
5.3 Change of Mind: We do not offer refunds for "change of mind" once an order is processed.
6. USER-GENERATED CONTENT (REVIEWS & PHOTOS)
6.1 License Grant: By posting reviews, photos, or "Before/After" results on our platform or tagging our official social media, the User grants KAYDEAN a perpetual, irrevocable, world-wide, royalty-free, and sub-licensable license to use, reproduce, and edit such content for marketing and promotional purposes.
6.2 No Compensation: The User acknowledges they are not entitled to any financial compensation, royalties, or "payouts" for the use of such content.
7. TOTAL LIMITATION OF LIABILITY
7.1 Maximum Cap: To the maximum extent permitted by the Consumer Protection Act 1999, the total aggregate liability of KAYDEAN for any claim (whether in contract, tort, or otherwise) arising from a Product or Service shall be limited to the actual price paid by the Customer for that specific Product/Service.
7.2 Exclusion of Damages: KAYDEAN shall not be liable for any indirect, incidental, or consequential damages (including loss of income, emotional distress, or medical costs) arising from the use of the Products.
7.3 Indemnity: The Customer agrees to indemnify and hold KAYDEAN harmless from any legal fees or costs arising from a breach of these Terms by the Customer.
8. DATA PROTECTION (PDPA 2010)
8.1 By providing skin data for consultation, the Customer consents to KAYDEAN processing "Sensitive Personal Data" for the purpose of creating a personalized routine. We comply with the Personal Data Protection Act 2010.
9. GOVERNING LAW
9.1 These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Malaysia.
